Ensure Your Vehicle Refinishing is Done Safely: Use Certified Operators


Kilkenny County Council’s Environment Section is reminding vehicle owners of the critical importance of using certified operators for vehicle refinishing services. Not only is this essential for the quality of the work, but it is also a legal requirement under current environmental legislation.

The Environmental Protection Agency (EPA) regulates vehicle refinishing activities due to their potential environmental impact. According to the European Union (Paints, Varnishes and Vehicle Refinishing Products) Regulations 2012, it is mandatory for any entity involved in vehicle refinishing to hold the appropriate certifications and to follow all regulations concerning the safe handling and disposal of substances used in the process.

Improper vehicle refinishing can lead to the release of harmful chemicals into the environment, posing risks to public health and local ecosystems. Certified operators are trained to manage these risks effectively, ensuring compliance with environmental standards and the safe use of materials in vehicle refinishing.

Under the Air Pollution Act (Fixed Payment Notice) (Paints) Regulations 2016 local authorities were provided with powers to issue on-the-spot fines to non-compliant body shops and paint suppliers. This gives local authorities a new enforcement tool to use in the enforcement of these regulations and allows fines of between €500 and €1,000 to be imposed on non-compliant operators.

Multiple fines can be imposed by local authorities on an operator until such time as they come into compliance with the requirements of the regulations.
